Medico-Legal Practice

Michael Foy has been a Consultant Orthopaedic Surgeon since 1989. His main areas of interest are General Orthopaedics(Hip/Knee), Trauma and Spinal Surgery. He is a founder member of the Expert Witness Institute(EWI) and a member of the MedicoLegal Society. He has recently been appointed Chairman of the Medicolegal Committee of the British Orthopaedic Association (BOA). He regularly lectures on MedicoLegal topics to both legal and medical audiences.

He is author and co-editor of MedicoLegal Reporting in Orthopaedic Trauma, first published in 1990 and now in its 4th edition. It is widely recognised by both the legal and medical professions as the standard text on musculoskeletal injury in personal injury litigation. The 4th edition was published in October 2010.

Personal Injury 

Around 50% of the Medicolegal practice involves personal injury litigation. Reports are comissioned by claimants solicitors, defence/insurance company solicitors and on a joint basis. The approximate ratio is 50/30/20 respectively.

Claimants can be seen either in Wiltshire or in London . The waiting time for appointments is usually 4-8 weeks, although on occasions people can be seen more quickly if there is a degree of urgency. Reports comply with the current legislation.

Medical Negligence Reports

Around 50% of the Medicolegal practice deals with cases where medical negligence is alleged. Around 70% of the work is on behalf of the claimant and 30% on behalf of the defence (usually the Hospital Trust/NHSLA.) Reports on liability & causation are usually prepared from the relevant/available medical records and XRays/Scans without the need to see the claimant. The turnaround time from formal receipt of instructions to provision of report is usually around 8 weeks.

If the case is to proceed then it may be necessary for Mr Foy to see the claimant for provision of a current condition & future prognosis report.
